Terms & Conditions

These Terms & Conditions govern your access to and use of the online store operated by YSTW LLC, doing business as YSTW and You See The Works (“YSTW,” “we,” “us,” or “our”), and your purchases from us.

By using our website or placing an order, you agree to these terms to the extent permitted by applicable law. If you do not agree, please discontinue use of the website.

Our Shipping Policy, Return & Refund Policy, and additional conditions disclosed for a particular product or promotion also apply. Our Privacy Policy explains how we handle personal information.

1. Eligibility and Website Use

You must have the legal capacity to enter into a binding agreement. If you are under the applicable age of majority, your parent or legal guardian must authorize your use of the store and any purchase.

You agree to provide accurate, current information and use the website only for lawful purposes.

We may restrict access or suspend accounts when reasonably necessary to address fraud, security threats, unlawful activity, or material violations of these terms. This does not eliminate obligations we owe for existing purchases.

2. Customer Accounts

You are responsible for maintaining the confidentiality of your account credentials and taking reasonable steps to prevent unauthorized access.

Keep your account information accurate and notify us promptly if you suspect unauthorized activity. You are responsible for activity you authorize or permit through your account, subject to applicable law.

3. Product Information

We make reasonable efforts to display accurate product descriptions, pricing, images, and availability. Errors may occasionally occur.

Colors may appear differently depending on your screen, settings, lighting, and photography. Measurements are approximate, and fit may vary by style.

Products featuring washes, dye treatments, distressing, or handcrafted finishes may vary between individual pieces when these characteristics are disclosed in the product description. Such variations do not excuse defects or material differences from what was advertised.

Please review the product description, size guide, care instructions, and purchase conditions before ordering.

4. Pricing, Promotions, and Payment

The applicable price and currency are displayed during shopping and checkout. Shipping charges and taxes collected by YSTW are shown before purchase.

Prices, availability, and promotional offers may change for future purchases. These changes do not retroactively alter accepted orders unless you agree or applicable law permits otherwise.

You represent that you are authorized to use the payment method submitted.

Promotions are subject to their disclosed conditions, including exclusions, expiration dates, and purchase limits. Discounts cannot be combined unless expressly permitted. Price adjustments on earlier purchases are available only when offered.

If a material pricing or product error affects your order, we may contact you for instructions or cancel the affected item and refund the payment collected for it. We will not charge a higher price without your agreement.

5. Order Review and Acceptance

An order confirmation acknowledges that we received your request. It does not confirm shipment or guarantee that every item can be supplied.

We may request reasonable verification before accepting or fulfilling an order. We may decline, hold, or cancel an order because of:

• Unavailable inventory.

• Incomplete or inaccurate order information.

• Payment authorization or verification issues.

• Reasonable concerns about fraud or unauthorized transactions.

• Violations of disclosed purchase limits.

• Automated purchasing activity or other material misuse of the store.

• Material pricing or product information errors.

Different billing and shipping addresses are permitted. However, flags from Shopify, payment providers, or fraud prevention tools may result in additional review, verification, or cancellation. A flag alone does not establish that a customer committed fraud.

If we cancel merchandise we cannot supply, we will refund the payment collected for that merchandise and any associated charges required by law. These refunds will not be restricted to store credit.

6. Purchase Limits and Automated Activity

Purchase limits apply when disclosed on a product page or with a release.

You may not evade those limits using multiple accounts, false identities, coordinated orders, bots, or other methods. We may cancel orders reasonably determined to violate a disclosed limit.

Using automated tools to manipulate inventory, bypass checkout restrictions, or obtain an unfair purchasing advantage is prohibited.

Any cancellation, return decision, or refund remains subject to applicable law.

7. Cancellation Requests and Order Changes

To request cancellation or an address correction, email info@ystwatelier.com as soon as possible with your order number.

We will attempt to accommodate requests received before fulfillment begins. Cancellation or modification is not guaranteed once packing or shipping has started.

Unless a legal cancellation right applies, orders that cannot be canceled must follow our Return & Refund Policy after delivery, if eligible.

8. Preorders and Made-to-Order Merchandise

Preorder and made-to-order items will be identified on their product pages, along with applicable production and shipment information.

Review the stated timeframe and purchase conditions before ordering. If shipment is delayed beyond the applicable timeframe, we will provide notice and the options required by law, including consent to a revised shipment date or cancellation and a refund where required.

Preorder or made-to-order status does not, by itself, eliminate mandatory cancellation, withdrawal, or defect-related rights.

9. Shipping and Delivery

Processing times, shipping options, and delivery information are described in our Shipping Policy and any applicable product disclosures.

You are responsible for providing a complete and accurate shipping address. If an address error causes additional shipping costs, we may ask you to cover reasonable, documented costs where legally permitted.

Carrier estimates are not guaranteed delivery dates unless expressly stated. Customs processing, weather, carrier disruptions, and other events may affect delivery.

Our responsibility for goods in transit, and the point at which risk transfers, are determined by applicable law and any valid shipping terms disclosed before purchase. A carrier handoff or delivery scan does not automatically resolve every claim concerning nonreceipt.

For missing, stolen, delayed, or damaged shipments, contact info@ystwatelier.com. We may request information reasonably needed to investigate or assist with a carrier claim.

10. International Purchases

Available destinations, shipping options, and charges are displayed at checkout.

Unless checkout expressly states that duties, import taxes, customs charges, or similar fees are included or prepaid, the recipient may be responsible for paying them separately.

If a package is refused or returned because of unpaid import charges or delivery issues, contact us regarding the resolution. Any deduction for shipping or other costs must be permitted by applicable law.

We do not guarantee reimbursement by customs authorities for duties or taxes. Any refund obligation YSTW has under applicable law remains unaffected.

11. Returns, Exchanges, and Refunds

Our Return & Refund Policy governs voluntary returns, including eligibility, condition requirements, exclusions, and instructions.

Eligible voluntary return requests must be initiated within 7 days of delivery. Returned merchandise must be unused, unworn, and in its original condition, with required packaging and hangtags intact.

Approved voluntary returns are issued as YSTW e-gift cards. An $8 restocking fee applies to domestic returns. For international returns, the return label fee disclosed during the request is deducted instead. Original shipping charges are excluded from voluntary return credit.

We do not currently offer direct exchanges. Merchandise identified as Final Sale is excluded from voluntary returns and exchanges.

These restrictions do not override mandatory rights concerning defective, incorrect, or misdescribed merchandise, statutory withdrawal rights, or other refunds required by law. Where a monetary refund is legally required, we will not substitute store credit without your agreement.

If these terms conflict with another policy concerning a mandatory consumer right, that right controls.

12. Damaged, Defective, or Incorrect Merchandise

Inspect your order after delivery and contact info@ystwatelier.com promptly if an item arrives damaged, defective, or incorrect.

Include your order number, a description of the issue, and photographs where reasonably available. We will review the matter and provide an appropriate resolution consistent with applicable law.

The voluntary 7-day return window, restocking fees, and Final Sale exclusions do not restrict statutory remedies.

Damage caused by misuse, accidents after delivery, improper care, or ordinary wear is not automatically a manufacturing defect. This does not limit applicable warranties or consumer protections.

13. E-Gift Cards

YSTW e-gift cards are redeemable through our online store, subject to the terms disclosed when issued.

Gift cards are not redeemable for cash except where required by law. Any expiration, fee, or other restriction applies only if properly disclosed and legally permitted.

Protect your gift card details. If a card is lost, stolen, or used without authorization, contact us. Replacement may require proof of purchase and verification of any remaining balance, subject to applicable law.

14. Intellectual Property and Permitted Use

Original website content, photographs, graphics, text, logos, designs, and other protected materials belong to YSTW or their respective rights holders.

You receive limited permission to access the website for personal shopping and other lawful, noncommercial use. This permission does not transfer ownership of intellectual property.

Unless authorized or permitted by law, you may not reproduce, modify, distribute, sell, license, or commercially exploit protected website materials or use YSTW branding in a way that suggests an unauthorized affiliation.

Purchasing merchandise does not transfer rights in its design or branding.

You may share ordinary links to our public pages, provided doing so does not misrepresent an affiliation, endorsement, or sponsorship.

15. Prohibited Conduct

You may not:

• Submit fraudulent information or use payment credentials without authorization.

• Access another customer’s account without permission.

• Introduce malware or interfere with website security.

• Attempt to bypass access controls or checkout restrictions.

• Extract protected content or personal information through unauthorized scraping.

• Use the website to infringe intellectual property, privacy, or other legal rights.

• Impersonate YSTW or another person.

• Harass or threaten customers, staff, or service providers.

We may investigate misuse and take appropriate steps consistent with applicable law.

16. Reviews, Feedback, and Other Submissions

Submit only content you have the right to provide. Your submissions must not be unlawful, misleading, infringing, or abusive.

If you submit a review or other content through a feature intended for public display, you grant YSTW a nonexclusive, royalty-free license to display, reproduce, and reasonably format that content for the purpose for which you submitted it, subject to applicable law and any disclosed feature terms.

Private customer-service communications are handled under our Privacy Policy and are not automatically licensed for advertising.

Please do not send confidential business proposals, inventions, or unpublished product concepts without a separate written agreement. Unsolicited suggestions do not create a confidentiality or compensation agreement merely because we receive them.

We do not prohibit honest reviews or lawful criticism.

17. Third-Party Services and Links

Our store uses Shopify and may offer services or links supplied by payment providers and other third parties.

Those services may have separate terms and privacy policies. We do not control independent third-party websites and do not guarantee their content or availability. A link does not necessarily imply endorsement.

This section does not exclude responsibility that applicable law places on YSTW.

18. Email and SMS

Marketing subscriptions are optional. Use the unsubscribe link in marketing emails to stop receiving them.

Our SMS program is supported by Postscript. If you separately opt in, you may receive the messages described in the subscription disclosure, including automated marketing and cart reminders.

Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply.

Reply STOP to unsubscribe or HELP for assistance. You can also contact info@ystwatelier.com.

Carriers are not responsible for delayed or undelivered messages. If your telephone number changes, unsubscribe the old number before subscribing with the new one.

Necessary order and customer-service communications may continue through an appropriate channel after marketing unsubscribes.

19. Website Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS INFORMATIONAL FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

We do not guarantee continuous access, error-free operation, or that the website will meet every user’s technical requirements.

This website disclaimer does not eliminate express product promises or warranties, implied warranties that cannot lawfully be excluded, or statutory rights concerning merchandise.

 

20. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YSTW AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL LOSSES ARISING FROM WEBSITE USE OR PURCHASES, INCLUDING LOST BUSINESS PROFITS.

Where legally permitted, YSTW’s total liability for a claim relating to a particular order will not exceed the amount paid to YSTW for that order.

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability, remedy, or consumer right that cannot lawfully be limited.

Some jurisdictions restrict liability exclusions. In those jurisdictions, these provisions apply only to the extent permitted.

21. Indemnification

To the extent permitted by law, you agree to reimburse YSTW for reasonable losses, liabilities, and legal expenses arising from a third-party claim caused by your unlawful use of the website, your material breach of these terms, or content you submit that infringes another person’s rights.

This obligation applies only to the extent the claim results from your conduct. It does not require you to reimburse YSTW for its own negligence, unlawful conduct, or breach of these terms.

YSTW will provide reasonable notice of a claim for which it seeks indemnification and an opportunity to participate in its defense. No settlement may impose an admission or nonmonetary obligation on you without your consent.

22. Events Outside Our Reasonable Control

We are not responsible for a failure or delay to the extent caused by circumstances beyond our reasonable control, such as natural disasters, government restrictions, or significant transportation or communications disruptions.

We will take reasonable steps to address affected orders. This section does not remove legally required notices, cancellation options, refunds, or other remedies.

23. Governing Law and Disputes

California law governs these terms, except where applicable federal law or mandatory consumer protections require otherwise.

If a dispute arises, we encourage you to email info@ystwatelier.com with the relevant details so we can attempt a resolution. Contacting us is not a condition that prevents you from exercising legal rights or meeting a filing deadline.

Subject to mandatory venue rules and consumer rights, disputes may be brought in the appropriate state or federal courts in San Diego County, California, and the parties consent to those courts’ jurisdiction where legally permitted.

You retain any right to bring an eligible claim in small claims court or another forum that applicable law guarantees. These terms do not impose mandatory arbitration or a class-action or jury-trial waiver.

24. Changes to These Terms

We may revise these terms and post the updated version with a new effective date. Updates apply prospectively unless applicable law requires otherwise or you separately agree.

The terms in effect when you place an order govern that purchase. We will provide additional notice or obtain agreement when required by law.

25. General Provisions

If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

A delay or failure to enforce a provision does not automatically waive the right to enforce it later.

You may not transfer contractual obligations under these terms without our written consent, except where legally permitted. This does not restrict lawful ownership transfers or resale of purchased goods.

YSTW may transfer these terms in connection with a legitimate business transfer, provided doing so does not reduce mandatory consumer protections.

These terms and the policies expressly incorporated into them form the agreement concerning website use and purchases, without excluding rights or representations that cannot lawfully be excluded.
